Eire’s Marine Casualty Investigation Board says that failure of the leading lights at Roonagh Pier were the main cause of the grounding of the passenger ferry Pirate Queen but further investigations revealed serious weaknesses in the navigational procedures and practices on the company vessels. There appeared to be an over reliance on visual aids to
navigation and a neglect to practice and use the electronic aids on board.

On the evening of 20th December 2011 the inter island passenger ferry Pirate Queen grounded on rocks at the entrance to Roonagh Pier, Co. Mayo. The vessel was refloated shortly afterwards and although not holed, it had sustained severe structural damage. Two of the passengers were taken off the ferry whilst she was on the rocks and transferred to the pier by a rigid inflatable boat. One passenger sustained injuries during the incident. Germany’s Federal Bureau of Maritime Casualty Investigation says that it cannot give precise conclusions regarding the collision between the ro-ro ferry Skania and the fishing vessel Gitte in part because of the refusal by Skania’s owner, Unity Line Co. Ltd of Szczecin, to release the vessel’s Voyage Data Recorder and markedly different accounts of the circumstances. BSU does use the incident to highlight the value of AIS aboard smaller vessels.

In its summary investigation report BSU says: “At about 0141 on 17 February 20091, the Ro/Ro ferry Skania, sailing under the flag of the Bahamas, collided with the fishing vessel Gitte, registered in the Federal Republic of Germany, while en route from Swinoujscie, Poland, to Ystad, Sweden. At the time, the fishing vessel anchored approx. 13 nm east of Rügen because of engine failure. For unknown reasons, the watchkeepers on the bridge of the ferry failed to notice the fishing vessel, which anchored on the ferry’s course line, collided with the starboard forecastle and then dragged the fishing vessel with her anchor line until it broke shortly afterwards.

Not unexpectedly, the master of the Sulpicio Lines ferry Princess Of The Stars will be deemed liable by a Board Of Marine Inquiry for its capsize and sinking with the loss of 800 lives. All other factors such as inadequate lashing of the cargo, modifications which punched holes through what was once a wagon deck so that it could be used for passengers and which may have allowed her to take on water and lose her main engine power as she listed, the possible lack of guidance to the master in the company’s safety management system are merely contributory and those responsible for those actions/inactions are faultless because the master, in theory, has ultimate responsibility.

The finding has the significant advantage of blaming a man who can no longer speak for himself, short of a spiritualist – the master is among those who lost their lives, along with the rest of the officers on the bridge at the time. His fault was to depart at a time when a typhoon was entering the Philippines, the assumption being, apparently, that ships of the size of the Princess Of The Stars, around 24,000 tonnes, simply naturally capsize and sink in a storm.

The view of every master MAC has spoken to is that the Princess Of The Stars should have been able to survive the storm, if with some discomfort to its passengers. The forensic evidence to establish the mechanism by which she sank remains underwater and apparently unwanted.

Yet there is a way in which the master could have spoken to us post mortem – a voyage data recorder, VDR. A device similar in concept to the ‘black box’, actually bright orange, carried by every commercial passenger aircraft in the Philippines. Earlier this year, following the sinking of the ferry Queen Of The North, which was not so equipped, the Canadian maritime authorities mandated that every ferry must be equipped with VDR.

So should the Philippines.

The VDR would have revealed what was actually said during radio traffic, discussions between the bridge team and what was showing on the instruments available to the bridge team, and whether those instruments were actually working.

It would tell us much that we need to know in order to learn the lessons needed to avoid similar incidents in the future, which is the aim of maritime investigation.

Through that device we would understand better the nature of the decisions made by the master. He could have spoken to us through it. It would have empowered the BMI, MARINA – the Philippine Maritime authority – and the Philippine Coastguard to do their jobs of making Philippine seas safer.

Despite hours of debate, however, VDR, possibly the greatest contribution to objective maritime accident investigation in the Philippines has yet to be mentioned.

MASTER’S POOR DECISION LED TO GROUNDING OF PASSENGER VESSEL EMPRESS OF THE NORTH, NTSB DETERMINES


Washington, DC – The National Transportation Safety Board has determined that the probable cause of the grounding of the Empress of the North was the failure of the officer of the watch and the helmsman to navigate the turn at Rocky Island, which resulted from the master’s decision to assign an inexperienced, newly licensed junior third mate to the bridge watch from midnight to 4:00 a.m. The third mate was not familiar with the route, the vessel’s handling characteristics, or the equipment on the vessel’s bridge.

“The flawed decision making in this accident created the potential for a catastrophic disaster,” said NTSB Chairman Mark V. Rosenker. “Those in leadership positions need to make sure they consider every option possible when making critical decisions that could put lives at risk.”

On May 14, 2007, the 300-foot passenger vessel Empress of the North, operated by Majestic America Line, grounded on a charted rock at the intersection of Lynn Canal and Icy Strait in southeastern Alaska, about 20 miles southwest of Juneau. The vessel was negotiating a turn west out of Lynn Canal into Icy Strait on its way to Glacier Bay, the next stop on a 7-day cruise, carrying 206 passengers and 75 crewmembers. The vessel struck the rock, known as Rocky Island, which was illuminated by a flashing green navigation light.

Passengers and crewmembers were evacuated safely without injuries. The vessel sustained damage to its starboard underside and propulsion system.

In the report adopted yesterday, the Board noted that because of the senior third mate’s illness, the master replaced him with the new junior third mate for the midnight-to-4:00 a.m. watch. The third mate held an unlimited, any-ocean third officer’s license but had never before stood watch on the vessel or traveled the waters of Lynn Canal.

The master had ample time to consider the watchkeeping assignment, the Board stated. However, the Safety Board investigators found no evidence that the master considered other options and did little to prepare the junior third mate for his first underway watch.

The third mate lacked any knowledge of the route and should not have been left to make this critical maneuver on his own, the Board said. The Safety Board concluded that the master jeopardized the vessel’s safety by allowing the third mate to stand a bridge watch before he was familiar with the route and the bridge equipment.

As a result of its investigation of this accident, the Safety Board recommended that state and U. S. maritime academies use the circumstances of the accident to teach students about their responsibilities as newly licensed officers. The Safety Board also recommended that the Passenger Vessel Association inform its members about the circumstances of the accident.
