As it happens, MAC was chatting to attorney Steve Gordon of Gordon & Elias last week about whether or not the Jones Act could be brought to bear on US companies whose crews are attacked or seized by pirates. and he answered yes. The issue would depend upon negligence being demonstrated, did the company take reasonable precautions. Now a member of Maersk Alabama’s crew steward Richard Hicks is suing Maersk for negligence.

It will be interesting to see how things pan out and how it affects US ships sailing off Somalia.
