Vincent Foley and John Irving of Holland & Knight have authored a Client Alert on the continuous duty “to maintain” an oil record book (ORB) on ships subject to both the MARPOL Convention and the jurisdiction of the United States.  The US Court of Appeals for the Second Circuit ruled that the duty to maintain an ORB included the requirement on a continuing basis for a foreign ship while in US waters to have an ORB with accurate entries (or at least not knowingly inaccurate entries).
